The present petition has been filed to invoke the jurisdiction of this Court under Article 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking speedy trial in case bearing CR Case No. 7/2018 titled as "State vs. Prem Singh & Ors." arising out of FIR No. 92/2014 dated 14.08.2014 for offences punishable under Sections 406/420/120B of the Indian Penal Code, 1860 registered at Police Station Economic Offences Wing, Delhi.

The learned counsel for the petitioner submits that the prosecution has cited 18 witnesses in the charge-sheet, however, till now, only two prosecution witnesses have been examined with the last witness i.e. PW-2 having been examined on 02.02.2023 and since then, no other witness has been examined. He further submits that the two prosecution witnesses i.e. PW-11, namely, Smt. Hansa Devi and PW-12, namely, Sh. Gajendra Singh though have been summoned on multiple dates of hearing by the learned Trial Court, they could not appear before the Court as various exemption applications were moved on their behalf.

The learned counsel submits that the case is pending adjudication since 2017 before the learned Trial Court, causing undue hardship to the petitioner. In this regard, the learned counsel requests that there should be expeditious disposal of the case, however, limiting his prayer that the witnesses i.e. Smt. Hansa Devi and Sh. Gajendra Singh be examined within a period of one month from today, the learned counsel seeks disposal of the petition. 6.

In view of the above, the learned Trial Court to ensure the evidence of Smt. Hansa Devi and Sh. Gajendra Singh is recorded expeditiously.

Accordingly, the present petition is disposed of in the above terms.
