Matter taken up on mentioning by both sides. It is informed by both sides that subsequent to last date they have compromised the disputes and the present petitioner/tenant has vacated the subject premises, so keys of the vacant premises have to be handed over today. Accordingly, the keys of the subject premises are handed over in Court by learned counsel for petitioner to learned counsel for respondent. Learned counsel for respondent on instructions of his client present in Court submits that they shall not claim any use and occupation charges from the petitioner/tenant and now there are no dues from each side.

Under these circumstances, as requested by learned counsel for petitioner, the petition along with the pending application is dismissed as withdrawn on compromise.
