The present writ petition has been filed seeking a direction to the respondents to take action against the unauthorized construction being carried out by the respondent no. 3 at the property bearing no. 3854/23, Regarpura, Karol Bagh, New Delhi (hereinafter 'subject property'). 2.

Counsel appearing on behalf of the respondent-MCD, on advance notice, submits that the construction in the subject property is being carried out pursuant to a sanction plan. He submits that till date, only the basement has been constructed.

In view of the above, the apprehension of the petitioner that the construction is unauthorized is misplaced.

Accordingly, the present writ petition is premature and is accordingly disposed of.
