Learned counsel for respondents submits that apparently none has appeared for appellant because this appeal has become infructuous. The appellant had assailed decree for recovery of possession of tenanted premises and outstanding rent. The said decree was passed under Order VIII Rule 10 CPC. It is informed by learned counsel for respondents that possession of the subject property stands restored to the respondents in execution and qua the monetary part of the decree, the appellant had assured before the Bailiff to clear the same.

Accordingly, the appeal and the pending application are dismissed in default.
