The present petition has been filed by the Petitioner- NTPC Employees CGHS Limited (hereinafter, 'Society') under Article 226 of the Constitution of India, inter alia, seeking conduct of inspection into the constitution, working and financial condition of the Society under Section 61 of the Delhi Cooperative Societies Act, 2003 (hereinafter, 'DCS Act'). 3.

The case of the Petitioner is that there are certain illegalities which have been committed by the earlier Managing Committee of the Society and therefore, the said inspection is necessitated. 4.

The submission on behalf of the Petitioner is that a letter was written to the Registrar of Cooperative Societies (hereinafter, 'RCS') on 14th May, 2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

and thereafter, an Inspection Officer was appointed i.e., Sh. M. G. Satya on 11th September, 2025. However, no action was taken by the said Inspection Officer. Thereafter further representations were made. However, since there was no response, the present writ petition has been filed. 5.

At the outset, Mr. Shashi Pratap Singh, ld. Counsel appearing for the RCS has submitted that the earlier Inspection Officer has submitted his resignation vide letter dated 9th April, 2026 expressing his inability to conduct the inspection due to official engagements. In view thereof, the RCS has already appointed a fresh Inspection Officer namely Sh. Pradeep Kumar, Jail Superintendent, Jail No. 13, Mandoli, Delhi as the inspecting officer to conduct a detailed inspection. The said order dated 15th May, 2026 has been placed on record by ld. Counsel for the RCS.

In view of the fact that a fresh Inspecting Officer has been appointed, the following directions are issued :- a. The new Inspecting Officer- Sh. Pradeep Kumar shall take over the records of the Society within a period of one week. b. The inspection of the records shall be conducted by the Inspecting Officer and a report shall be submitted within a period of 90 days as contained in the order dated 15th May, 2026 passed by the RCS. c. All parties including the Petitioner Society, present Managing Committee and the erstwhile Managing Committee shall cooperate and give any documents or information the inspecting officer may seek from them. Any non-cooperation shall be liable to be viewed stringently.
