% 26.04.2018 By this appeal, the appellant challenges the order dated 8th September, 2015 whereby the learned Trial Court directed filing of the complaint against Brij Lal (PW-23) i.e. the appellant herein and Vinod Kumar (PW-24) to the Court of learned CMM as per Section 340 Cr.P.C. for registration of the case under relevant Section.

After some arguments, learned counsel for the appellant seeks leave to withdraw the appeal.

Appeal and the application are dismissed as withdrawn. MUKTA GUPTA, J.
