By virtue of the present petition under Articles 226/227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs: "A. Quash/ Modify the Conditions Of Release Of Passport And To Travel broad Vide Order Dated 06/05/2026 Passed By LD. ASJ-04, West District In ECIR No. ECIR/HIUII/24/2025 titled as "Enforcement Directorate Vs Amit Gupta Sandeepa Virk" of deposit of FDR of Rs. 20,00,000/- (Twenty Lakh Only) and condition requiring reporting to the Indian Embassy on Arrival.

Further directing the Trial' Court not to impose the condition of deposit of FDR and reporting to the Indian Embassy on Arrival, in future as a pre-condition for release of passport and permission to travel abroad in the captioned ECIR/HIU-II/24/2025 Dated 11.08.2025 titled as "Enforcement Directorate Vs Amit Gupta & Sandeepa Virk".

Any other order(s) that this Hon'ble Court may deem fit and necessary in the interest of justice." 2.

Learned counsel for the petitioner submits that the petitioner has been able to satisfy the learned Trial Court for the prayer he is seeking herein, and according to him the petitioner is primarily aggrieved only qua some of the conditions imposed by the learned Trial Court therein, including the issuance of furnishing of the FDR in the sum of Rs. 20,00,000/- (Rupees Twenty Lakhs Only), which he is not in a position to pay, as also other condition(s).

Based thereon, he seeks, and is granted, liberty to withdraw the present petition to take appropriate steps in accordance with law before the learned Trail Court which has passed the order dated 06.05.2026 seeking modification of the various conditions imposed therein including furnishing of the FDR.

As such, the present petition, alongwith the pending application, is dismissed as withdrawn with liberty as prayed for. SAURABH BANERJEE, J.
