Heard the learned Counsel for the Parties.

The contention made in this Appeal apart from the submissions on merits, is that the Appellant could not present her case before the learned Single Judge for certain reasons and though the impugned order decides the issue on merits, however, the Appellant could not be heard. 9.
In the aforesaid view of the matter, in our opinion, it would be more appropriate for the Appellant to seek recall / review of the order dated 05.02.2026 passed by the learned Single Judge by moving an appropriate application.

The learned Counsel for the Appellant, thus, states that she may be permitted to withdraw the Appeal with the liberty to move an appropriate application before learned Single Judge seeking recall / review of the order dated 05.02.2026.
