Present application has been filed under Section 151 CPC, 1908 seeking amendment of memo of parties filed in the review petition No.33099/2024 and CM Appl. No.24279/2024.

Learned counsel for the Applicant states that the memo of parties of the review petition was inadvertently prepared from the memo of parties of the petition filed before the Financial Commissioner by Mr.Shivi Chopra & Mr.Sarveesh Chopra. Thereafter, the Petitioner Mr.Sarveesh Chopra passed away in 2010.

She states that while filing the subject petition before this Court, the legal representatives of Mr.Sarveesh Chopra were arrayed as Petitioners No.2, 3 and 4.

She states that due to a misunderstanding on the part of the office of the Applicant-Counsel, late Mr.Sarveesh Chopra was made party to the review petition, erroneously and inadvertently, rather than the legal representatives who were Petitioners No.2, 3 and 4 in the writ petition. 5.

She states that the Applicant-Counsel regrets committing the above mentioned mistake and tenders an unconditional apology for the above stated procedural flaw. She states that that nothing was intentional or had been committed to mislead this Court or to commit a mischief by the Applicant-Counsel.

Learned counsel for the non-applicants accept notice. They have no objection to the present application being allowed. Accordingly, the present application is allowed and the amended memo of parties is taken on record.
