versus INDIAN RAILWAY CONSTRUCTION COMPANY LIMITED ..... Respondent (Review Petitioner) Through:
Mr.R.S.Hegde, Advocate with Mrs.Farhat Jahan Rehmani, Advocate CORAM: JUSTICE S.MURALIDHAR
O R D E R
% 16.02.2018 I.A.No.2130/2018 (exemption)
1. Allowed subject to all just exceptions.
Review Petition No.69/2018, I.A.No.2129/2018 (delay of 301 days in filing), I.A.No.2128/2018 (stay)
2. The Court has perused the application for delay of 301 days in filing the Review Petition. The reason adduced in the application is that there was an examination of the impugned order at various levels within the organization and that this took considerable time. The Court is not satisfied with the explanation offered. It does appear that the delay is extraordinary and is not liable to be condoned.
3. The Court has also examined the review petition on merits and does not find any ground made out for review of the order dated 3rd March, 2017.
Consequently, the review petition is dismissed both on the grounds of delay as well as on merits. The other pending application is also dismissed. S. MURALIDHAR, J FEBRUARY 16, 2018/'anb'
