The present Writ Petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the wife of the petitioner as also the minor daughter aged about five years. 2.

Pursuant to our order dated 25.05.2026, Mrs.Laxmi, wife of the petitioner, has appeared in person before us along with the minor child. We have interacted with the petitioner, Mrs.Laxmi, as also the minor child.

minor child under the influence of alcohol and that this conduct had continued over a long period of time.

She further states that, fearing her own safety as well as the safety of the minor child, she left the matrimonial home and is now living separately from the petitioner.

As Mrs.Laxmi and the minor child have appeared before us in person, and she is now residing separately out of her own free will and has apprehension about her safety and safety of the minor child in case she is forced to return to the petitioner, no further orders can be passed in the present petition, and it has served its purpose. 6.

The petitioner shall, however, be at liberty to initiate appropriate legal proceedings as may be advised in accordance with law before the Competent Court.
