The present writ petition is filed seeking direction to MCD to demolish the unauthorised construction being raised over property bearing No.18/1 Ground Floor, Indra Vikas Colony, Dr. Mukherjee Nagar, Delhi110009 ('subject property'). Photographs have been filed along with the present petition to show the construction activity being carried out. 2.

It is contended that the petitioner resides on the second floor of the subject property and on the ground floor the private respondents no.2 to 4 are carrying out unauthorised construction and converting ground floor into five (5) shops which is not permissible as the subject area is a residential area 3.

Issue notice.

respondents no.2 to 4.

Counsel appearing on behalf of MCD on advance notice submits that the subject property was found locked and hence, could not be inspected by MCD.

Counsel appearing for respondents no.2 to 4 submits that they are neither the owners of the property nor the builders and hence have nothing to do with the subject property.

In this view of the matter, a direction is issued to MCD to break open the locks and inspect the subject property.

In the event any unauthorised construction is being found to be carried in the property, an appropriate action in law shall be taken forthwith. 9.

MCD shall also ensure that no further unauthorised construction is carried out in the subject property.

In view of the above, the petition stands disposed of. 11.

Liberty is given to the petitioner to take appropriate remedies as per law in the event the petitioner has further grievance. 12.

All rights, contentions and legal remedies of the owner/occupier are kept open.
