Petitioner herein seeks quashing of FIR No. 0003/2026 dated 01.01.2026022, registered at Police Station Karol Bagh, for commission of offences under Sections 64(1)/115(2) of Bharatiya Nyaya Sanhita (BNS), 2023, (corresponding Sections 376/323 IPC) along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

Charge-sheet has already been filed.

Respondent No.2 is present with the counsel. I.O. is also present and respondent No.2 is found adamant and states that in terms of amicable settlement, the FIR in question may be quashed. 4.

However, as per the abovesaid FIR, respondent No.2 has made serious allegations and merely because there is a settlement between the parties would not mean that the Court would quash the FIR, particularly when the CRL.M.C. 3911/2026 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. allegations concern commission of sexual assault. 5.

After hearing arguments, learned counsel for the petitioner seeks to withdraw the present petition with liberty to file it afresh once the evidence of respondent No.2 is recorded by the Court.

The present petition is disposed of as not pressed. 7.

Pending application also stands disposed of.

Liberty, as prayed, is granted.
