O R D E R

The present contempt petition has been filed against the respondent for willful disobedience of the order dated 20th July, 2021 passed on the basis of an undertaking given to this Court through a settlement agreement dated 18th March, 2021. One of the undertaking given by the respondent was to refrain himself from manufacturing, selling and offering for sale, etc. or in any manner dealing in certain products which were imitations of the petitioner's registered designs.

By way of the present contempt petition, it is the case of the petitioner that it came to his knowledge that the respondent was still manufacturing and selling a product which imitates the petitioner's design (Design No. 300416). The sole of the said product is an exact replica of the petitioner's design.

Today learned counsel appearing for the respondent along with Mr. Sunny Goel, respondent no.1 in person, has given an undertaking to the Court that the respondents shall discontinue with the manufacturing and selling of the product which imitates the petitioner's design in any manner. 4.

It is further submitted on behalf of the learned counsel for the respondents that though the respondents dispute the fact that the impugned design qua which the present contempt petition has been filed, does not fall within the terms of the settlement agreement dated 18th March, 2021 between the parties, however, in order to put an end to the dispute between the parties, they are willing to undertake not to further carry out any manufacturing of the design which may imitate the petitioner's design in any manner.

Learned counsel for the petitioner expresses satisfaction and states that he does not wish to pursue the present contempt petition in view of the undertaking given by the respondent.

In view of the aforesaid, the present contempt petition is disposed of as satisfied.
