1. As already noted in the order dated 29th January, 2016, the bank guarantee in question has already been encashed.

2. Learned counsel for the Petitioner requests that the original measurement books be produced by the Respondent for verification purposes so that the claim of the Petitioner can be formulated. Counsel for the Respondent states that the Respondent is not averse to showing the measurement books to the Petitioner if a written request in that regard is made.

3. In that view of the matter, it is directed that if a written request is made by the Petitioner within two weeks, the Respondent will provide to the petitioner copies of the measurement books in question. No further directions are called for as far this issue is concerned. O.M.P.(I) (COMM.) 28/2016

4. Since the process of appointment of Arbitrator has already been initiated, any further interim order can be sought by either of the parties in the arbitral proceedings.

5. The petition is disposed of.
