By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 526/2021 dated 04.09.2021, lodged at Police Station Govind Puri, District South-East, Delhi, under Sections 302/201 of the Indian Penal Code, 1860.

At the outset, Mr. Tarang Srivastava, learned Additional Public Prosecutor for the State, states that material witnesses are yet to be examined, including the persons who are alleged to have identified the applicant from the CCTV footage.

identification of the applicant, I am of the view that, rather than releasing the applicant on bail at this stage, it is appropriate to grant him liberty to approach the Sessions Court at the appropriate stage, including in the event the evidence of the material witnesses is inordinately delayed. 4.
Mr. Srivastava states that the prosecution will indicate to the Sessions Court the names of those witnesses, who are required for identification of the applicant.

Having regard to the period of custody of the applicant, the Sessions Court is requested to expedite the recording of evidence of the material witnesses, subject to its own Board and the age of matters pending before it.

The bail application, alongwith pending applications, is disposed of in terms of the above.

It is made clear that this Court has not made any comment on the merits of the case or on any proposed application before the Sessions Court, which may be considered by the Sessions Court in accordance with law.
