% 26.10.2016 1.

None appears for the plaintiff or for the defendant no.2 Central Council of Indian Medicine (CCIM).

2.

The counsel for the defendant no.1 states i) that this suit was filed for declaration that the plaintiff has been validly elected to the post of President of CCIM and for mandatory injunction restraining the defendant no.1 from interfering with the performance of functions and duties by the plaintiff as President of the defendant no.2 CCIM; ii) that the membership of the plaintiff of CCIM and by virtue of which membership she claimed to have been elected as President of CCIM was by way of nomination by the Government of India; iii) that the said nomination of the plaintiff by the Government of India was challenged before the Madurai Bench of the Madras High Court and it was held that the nomination by the Government of India of the plaintiff as member of the defendant No.2 CCIM was invalid and illegal; iv) that the plaintiff preferred an SLP to the Supreme Court and which has also been dismissed on 7th April, 2016. CS(OS) 33/2016

3.

A perusal of the file shows that none has been appearing for the plaintiff before the Joint Registrar on 11th July, 2016 and 2nd September, 2016.

4.

A perusal of the order dated 11th February, 2016 shows that the Central Government was also impleaded as the defendant to this suit. 5.

It appears that not only this suit has become infructuous but the plaintiff has also lost interest.

6.

Dismissed in default.
