The petitioner has filed the present petition, inter alia, praying that FIR No. 0439/2019 under Sections 323/354(B)/506/509 of the IPC, registered with PS Kalyanpuri, Delhi and all proceedings emanating therefrom, be quashed.

The said FIR was registered at the instance of respondent no.2. She had alleged that on 24.08.2019 at about 9:00 PM, she was sitting outside her residence and the petitioner, who was a neighbour had approached and slapped her. caught hold of her hair and had also torn her clothes. She alleged that he had used abusive language against her and continued to do so. 4.

The FIR was registered almost a month later, that is, on 17.09.2019. 5.

Respondent no.2 has joined the proceedings through video conferencing. She is identified by the Investigating Officer. She states that the petitioner is related to her and is one of her cousins. She states that there was minor dispute between them and, therefore, filed an FIR. However, the said disputes have since been resolved in terms of the Settlement Deed dated 11.08.2020, copy of which has been placed on record. She states that she has no grievance against the petitioner and joins him in praying that the FIR in question be quashed.

The petitioner has also joined the proceedings and states that he has no grievance against respondent no.2.

In view of the statements made by the petitioner and respondent no.2, the present petition is allowed and the FIR No.0439/2019 under Sections 323/354(B)/506/509 of the IPC, registered with PS Kalyanpuri, Delhi and all proceedings emanating therefrom, are quashed.
