% 25.01.2016 CM No. 2501/2016 (exemption) The exemption is allowed subject to all just exceptions. W.P.(C) 608/2016 and CM No. 2500/2016 This petition was in connection with the Notice dated 02.09.2015 with regard to inter alia the e-auction for shop Nos. 1, 2 and 3 at Hamilton Road, 1/2772 near MCD Dispensary, Kashmere Gate. Since only single bids had been received in respect of these shops and the petitioner happened to be the only bidder, for better competition, the entire e-auction has been cancelled and it has been decided by the competent authority of the North Delhi Municipal Corporation to return / refund the earnest money deposited by the bidders immediately. We are told that instructions have already been given for the refund of the EMD through RTGS. It is in these circumstances, that the learned counsel for the petitioner does not press this petition any further. The learned counsel for the

respondent, however, points out that the petitioner may participate in the fresh e-auction which has been notified on 18.01.2016 and of which the last date of submitting the bids is 29.01.2016 till 3 pm. The petitioner would be free to participate in that auction. The writ petition stands disposed of.
