The Application for Discharge had been filed on behalf of the Petitioner in a Complaint Case under Section 138 of the Negotiable Instruments Act, 1881, wherein the learned Metropolitan Magistrate has rightly observed that there is provision for discharge of the accused at the stage of framing of Notice and dismissed the Application vide Order dated 06.02.2021.

By way of present Revision Petition, the Petitioner has challenged the impugned Order dated 06.02.2021.

In any case, the case before the learned Trial Court is at the stage of defence evidence.

In view of above, there is no merit in the present Petition, which is hereby dismissed along with pending Application.
