% 03.02.2017 After some arguments, learned counsel for the petitioner wishes to withdraw the present writ petition and application with liberty to file a civil suit. With the aforesaid liberty, the present writ petition and application are disposed of.

In the event, the suit is filed within a period of six weeks, the trial court is directed to decide the same as expeditiously as possible preferably within a period of one year.

However, it is clarified that this Court has not expressed any opinion on the merits of the controversy. Rights and contentions of all parties are left open.
