Second Bail Application under Section 483 BNSS has been filed on behalf of the Petitioner/ Applicant Sultan Azim on medical grounds for grant of Interim Bail for a period of three months. 2.

It is submitted that he is suffering from CAD old IWMI EF 45-50% which is related to heart which can cause heart attack, LBA chronic, LBP with Radiculopathy pain in abdomen, back, right shoulder and chest. It is submitted that the Applicant has been taking his treatment in Jail since February, 2024, but his ailments are getting worse day by day. 3.

He was granted Interim Bail on 18.12.2024 for a period of 30 days for treatment by learned Trial Court. He had been diagnosed with an anterior compression fracture of the D-8 vertebra in the spine, causing severe mobility issues and pain and has been advised to undergo surgical treatment. The Petitioner has thus, sought an Interim Bail for three months for proper medical treatment. 4.

In support of the Application, the Medical Report dated 15.05.2025 has been received from the Hospital describing his Medical condition. 5.

The Counsel for the Petitioner today has placed on record the medical prescription of Chawla Medical and Surgical Centre dated 18.05.2025, wherein the Applicant has been recommended to admit himself in the Hospital on 29.05.2025 for complete check-up and admission and the surgery is proposed to be conducted on 30.05.2025. 6.

Learned Prosecutor submits that this document has to be verified. 7.

Considering the Hospital record received from the Jail Superintendent and the other medical record including latest prescription, it is hereby directed that the Petitioner be released on Interim Bail from 26.05.2025 till 15.06.2025 to enable him to undergo the requisite Surgery, upon his furnishing a personal bond in the sum of Rs.25,000/- and one surety of the like amount, before the Jail Superintendent to the satisfaction of the Jail Superintendent, and further subject to the following conditions:- a) Applicant shall not leave Delhi/NCR without prior permission of the Court;

b) Applicant shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

c) Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. d) Applicant shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner. Upon expiry of period of Interim Bail, as stated above, the Applicant shall surrender before the concerned Jail Superintendent. 9.

The copy of the Order be sent to the concerned Jail Superintendent. 10.

In the interim the medical documents may be got verified by the learned APP for the State and in case these documents are found to be fabricated or that no surgery is scheduled, the State is at liberty to move an Application for cancellation of the Interim Bail. 11.

The Application is accordingly disposed of.
