The petitioner assails an order dated 17.02.2026, by which the learned Family Court has directed him to pay ad-interim maintenance of Rs.25,000/- per month to his wife and two daughters [respondents herein].

Mr. R.P. Bhardwaj, learned counsel for the petitioner, submits that the learned Family Court has wrongly proceeded on the basis that the petitioner's income is Rs. 30,00,000/- per month. He submits that no such case is made out, even from the application filed by the respondent No. 1. 3.

The reference to income of Rs. 30,00,000/- per month appears to be a typographical error in the impugned order. The averment in the application is that the petitioner has an income of Rs. 1,30,000/- per month. After some hearing, Mr. Bhardwaj, seeks permission to withdraw this petition, without prejudice to the rights and remedies available to the petitioner before the learned Family Court, including by filing an application for modification of the impugned order, if the circumstances so permit.

The petition, alongwith pending application, is dismissed as withdrawn in terms of the above submission.

It is made clear that this Court has not made any comment on the merits of the case or on any proposed application before the learned Family Court, which may be considered by the learned Family Court in accordance with law.

Needless to say, as notice has not been issued to the respondents, the rights and contentions of all parties remain reserved.
