Petition is listed on an office note in view of the report received from the Additional Superintendent Central Jail No.10, Rohini Delhi that the petitioner has not surrendered in case FIR No.206/2009 under Section 302 IPC, registered at PS Adarsh Nagar.

Learned counsel for the petitioner relies upon the order of the Full Bench of this Court dated 13th July, 2020 wherein the Full Bench of this Court noted that the prisoners including the convicts who have been released on interim bail/bail/parole by the Court and extensions are being granted from time to time, their interim bail/bail/parole have been extended. Learned counsel for the petitioner further states that the order of the Full Bench of this Court directing the prisoners on interim bail/bail/parole to surrender back has been stayed by the Hon'ble Supreme Court in SLP (Civil) No.013021/2020 titled National Forum on Prison Reforms versus Government of NCT of Delhi & Ors.

Considering the fact that the petitioner was granted parole by this Court vide order dated 20th August, 2020, he would be governed by the directions of the Supreme Court passed in National Forum on Prison Reforms (supra) and not by the directions of the D.G. (Prisons) dated 1st February, 2021.

No further orders are required to be passed at this stage. 6.

Copy of this order be sent to the concerned Superintendent Jail. 7.
