WP(C) 705/2017 Learned counsel for the respondents have waived their rights to file replies, in view of a short issue and controversy involved. The grievance of the petitioner is that notice in OA No.1476/2016 was issued on 20.4.2016 and was accepted by the respondents on the same date. Till date, replies have not been filed by the respondents to the said OA. Learned counsel for the petitioner has drawn our attention to several orders by which repeated adjournments were granted to the respondents to file replies. Our attention is also drawn to the order dated 16.11.2016 by which three weeks' time was granted to the respondents to file replies and

the petitioner was granted two weeks' time to file rejoinder after the replies were served. The case was adjourned to 1.2.2017. Learned counsel for the petitioner submits that, till date, i.e. 27.1.2017, copy of the replies have not been received. In fact, learned counsel for the petitioner submits that in case respondents file replies within two weeks, he would have no objection. We take this statement on record and direct the respondents to file relies, if not already filed, within two weeks from 1.2.2017, i.e., by 15.2.2017. In case the replies are not filed by the respondents within the said period, they will pay costs of Rs. 10,000/- to the petitioner for the adjournment and the delay caused in the decision of the OA No.1476/2016. If cost has to be paid, it will be also open to the respondents to ascertain the officer who has caused the delay and recover the cost from the said officer. With the aforesaid observations and directions, we dispose of the writ petition.
