He submits that the present petition has been inadvertently listed inasmuch as the petitioner has filed another petition viz. CONT.CAS(C) 863/2026 on the same cause of action. The same came up for hearing before this Court on 14.05.2026.

It is submitted that the present petition has been inadvertently numbered and listed during the process of re-filing. 5.

The petition is accordingly, dismissed as withdrawn, with liberty to the petitioner to pursue CONT.CAS(C) 863/2026.
