Exemptions are allowed, subject to the condition that the petitioner will file the duly sworn/attested affidavits, vakalatnama and certified copies of the annexures and within 72 hours from the date of resumption of the regular functioning of this Court.

BAIL APPLN. 2250/2020 1.

By this application filed under Section 439 Cr.P.C., the petitioner seeks regular bail in FIR No. 400/2020 registered under Sections 308/34 IPC at P.S. Bhalswa Dairy.

Mr. B.S. Rana, learned counsel for the petitioner submits that no recovery has been effected from the petitioner who is in judicial custody BAIL APPLN. 2250/2020 Page 1 of 3

since 10.07.2020. He further submits that the investigation qua the petitioner stands completed and the nature of the injuries sustained by the victim was opined to be simple. Learned counsel further submits that in case the petitioner is admitted to bail, he will be available on his mobile numbers i.e. 9971377454 and 9811790471, which he will keep operational during the period of his release.

Dr. M.P. Singh, learned APP for the State accepts the notice. Learned APP has opposed the bail application. He contended that the present petitioner along with other co-accused, has beaten the victim/complainant with danda and fist blows. However, on instructions from the I.O., learned APP confirms that the nature of injuries has been opined to be simple and the petitioner is not involved in any other case. 5.

Looking into the facts and circumstances of the case and the fact that the petitioner is not involved in any other case and the nature of injuries has been opined to be simple, it is directed that the petitioner be admitted to bail subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent/Duty M.M. and subject to further following conditions :- i) The petitioner shall remain available on his mobile phone numbers i.e. 9971377454 and 9811790471 which he has undertaken to keep operational during the period of his release.

ii) The petitioner shall not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence.

iii) The petitioner shall remain in touch with IO ASI Ram Kishan on his mobile number 9643695472 or SHO, P.S. Bhalswa Dairy on his mobile phone number 7065036328 on the first Monday of each English calendar month.

iv) In case of change of his address or mobile phone number, the petitioner shall promptly inform the same to the IO/SHO P.S. Bhalswa Dairy as well as the trial court.

v) The petitioner shall regular appear before the trial court.
