Criminal Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (erstwhile under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioner, Rishabh @ Rishi for quashing of FIR No. 614/2023 dated 12.10.2023 under Section 363/366/376 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') and Section 6 of POCSO Act, registered at Police Station Govindpuri, New Delhi, Charge Sheet dated 15.12.2023 and all the consequential proceedings emanating therefrom, in view of the Settlement The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

On advance Notice, learned APP for the State has appeared and accepts the Notice on behalf of the State.

It is submitted that the Petitioner and the Respondent No. 2 got married when the girl was almost 17 years and 10 months. At that time, they had not established their relationship. The child has been born almost after one year i.e. on 11.10.2023 while the Prosecutrix attained majority on 30.11.2022. In the circumstances, the quashing has been sought. 7.

On the Complaint of the Respondent No.2, FIR No.614/2023 dated 12.10.2023 under Section 363/366/376 IPC and Section 6 of POCSO Act, got registered at Police Station Govindpuri, New Delhi. 8.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 19.05.2025. In the Settlement, it was inter alia settled between the parties that the Respondent No. 2/wife shall withdraw all the proceedings pending against the Petitioner.

Today, the Respondent No. 2/wife, who is present in the Court, states that she has no objection if the said FIR is quashed. 10.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering that the Petitioner and the Respondent No. 2 had got married at that time when the Prosecutrix was almost at the age of majority The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

and that the child has been born one year after her attaining the majority and also that there are no allegations of sexual harassment, FIR No. 614/2023 dated 12.10.2023 under Section 363/366/376 IPC and Section 6 of POCSO Act, registered at Police Station Govindpuri, New Delhi, Charge Sheet dated 15.12.2023 and all the consequential proceedings emanating therefrom are quashed.
