The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No. 438/2013 registered under Sections 498A/406/354A/34 IPC at P.S. Bindapur, New Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No. 1 (husband) whereas petitioner Nos. 2 and 3 are relatives of the petitioner No.1. 3.
Mr. Laksh Khanna, learned APP for the State submits that in the present case petitioners are the only accused persons and respondent No. 2 is the only complainant/victim. He further submits that no other proceedings are pending between the parties.

Learned APP further submits that the parties have arrived at a settlement on 01.09.2025 before the Counselling Cell, Family Courts, Dwarka Court, New Delhi. It is further stated that the parties have been granted divorce vide order dated 13.05.2016 passed by the Principal Judge, Family Court, Dwarka Courts, New Delhi. He further states that a child is born out of the wedlock. Petitioner no.1 undertakes that the rights of the minor child shall remain unaffected by the aforesaid settlement arrived at between the parties. In terms of the settlement, respondent No.2 is left with no claims against the petitioners.

Petitioners as well as respondent No.2, who are present in Court, have been identified by I.O/SI Balu Ram, PS Najafgarh, Delhi. Respondent No.2, who is also present in Court, is identified by her counsel as well as the I.O. 6.
Respondent No. 2 states that she has entered into the aforementioned settlement out of her own free will, volition and without any coercion. She also acknowledges the receipt of entire settlement amount and submits that she has no objection in case the FIR is quashed. 7.
The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.
