O R D E R

% 24.01.2017 Learned counsel for the petitioners has made oral prayer for impleadment of Sanjay Kumar and Mohan Lal (injured persons), who are sons of respondent no.2 (complainant/injured). Above named persons are impleaded as respondent nos.3 & 4. Let amended memo of parties be filed during the course of the day.

It is submitted that petitioners and respondent no.2 have settled their disputes amicably vide settlement deed dated 14th September, 2016. It is further submitted that cross FIR No.627/2014 under Section 308 IPC was

also registered at police station Chhawla, New Delhi on the complaint of petitioner no.1 against complainant party. Present FIR No.258/2016 under Sections 323/452/506/326/120B IPC was registered at police station Chhawla on the complaint of respondent no.2.

Vide settlement deed (Annexure B), both the cases have been settled between the petitioners and respondent no.2.

It is further submitted that cross FIR No.627/2014 has already been quashed by Mukta Gupta J. today in Crl.M.C. No.3954/2016. Respondent nos.2 to 4 are present in Court and have been identified by Inspector Satbir Singh PS Chhawla. They submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure and coercion. They further submit that they have no objection in case present FIR is quashed.

Keeping in mind the settlement arrived at between the parties and that the cross FIR has already been quashed, in the interest of justice, FIR No.258/2016 under Sections 323/452/506/326/120B IPC registered at police station Chhawla, is quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
