After some arguments, learned counsel for the appellant wishes to withdraw the present appeal as well as the underlying writ petition with liberty to file appropriate proceedings in accordance with law. 2.

With the aforesaid liberty, present appeal and underlying writ petition are dismissed as withdrawn along with the applications. It is clarified that in the event the appellant files appropriate proceedings in accordance with law, the same shall be adjudicated on merit without being influenced in any manner by the observations made by the learned Single Judge. This Court clarifies that it has not commented on the merits of the controversy, but on the remedy adopted by the petitioner. The rights and contentions of all the parties are left open.
