This application has been preferred for waiver of costs in a disposed of writ petition.

The application has been preferred by this applicant (original petitioner) in W.P.(C) 5518/2020 which was dismissed by this Court vide order dated 21.08.2020 with costs of ₹25,000/- to be paid by this petitioner to Delhi State Legal Services Authority.

After canvassing arguments for some time, learned counsel for the applicant (original petitioner) prays for reduction of costs. 4.
Looking to the averments and allegations in the writ petition, all allegations were against one Mr. Amanatullah Khan, who was contesting in the elections for Delhi Waqf Board, and he was not joined as a party respondent.

Having regard to the nature of the matter and arguments canvassed by the counsel for the petitioner, we opined that W.P.(C) 5518/2020 is not a bona fide Public Interest Litigation at all and therefore imposed costs of ₹25,000/- on the petitioner. Today also, after hearing the counsel for the applicant (original petitioner), we are of the same opinion. Further, the writ petition (in paragraph 17) contains a specific averment that the petitioner has the means to pay the costs, if any, imposed by the Court, and that he undertakes to pay the same.
