The present writ petition has been filed seeking a direction to the respondent no.1/ MCD to take action against the unauthorized construction being raised by the respondents no.4 to 7 at the Plot bearing No. 87A admeasuring 1440 Sq. Yds. situated at Gurudwara Bala Sahib Road, Jeewan Nagar, Bhagwan Nagar, New Delhi (hereinafter 'subject property'). 2.

petition inasmuch as the address of the petitioner given in the memo of parties is that of Noida, Uttar Pradesh. In any event, Mr. Nath submits that a demolition order has been passed in respect of the subject property, after following due process of law.

A perusal of the memo of parties as well as the AADHAR Card filed by the petitioner (Annexure-A to the writ petition) clearly states that the petitioner is a resident of Noida, Uttar Pradesh. It is evident that he does not have the locus to maintain the present writ petition. 4.
In view thereof, Mr. Tandon, senior counsel for the petitioner, on instructions, seeks to withdraw the present writ petition. 5.
Accordingly, the present writ petition is dismissed as withdrawn. 6.
Needless to state, the respondent no.1/ MCD shall continue to take action in accordance with law.
7.
All rights, contentions and legal remedies of the private respondents are left open.
