The present petition has been filed seeking issuance of mandamus thereby directing the respondent to restore the lease of the property bearing No. B-8/Block-3, Khasra No. 1314/1279, New Rajinder Nagar Extn. New Delhi, in view of the order dated 10.01.2019 passed by the learned Estate Officer.

The learned counsel appearing on behalf of respondent/DDA submits that the said order of the learned Estate Officer has been set aside in an appeal preferred by the DDA being PPA No. 1/2020, vide judgment dated 09.05.2024 passed by the learned Principal District and Sessions Judge, Central District, Tis Hazari, Delhi.

Judge, Central District, Tis Hazari, Delhi has been challenged by the petitioner by filing a separate writ petition being W.P.(C) 9282/2024. 4.
In view of the judgment of the Estate Officer having been set aside, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to revive the same in the event the petitioner succeeds in the aforesaid writ petition i.e. W.P.(C) 9282/2024. 5.
The petition is dismissed as withdrawn with liberty as aforesaid. 6.
At this stage, the learned counsel appearing on behalf of the respondent DDA submits that the concerned official from the office of DDA is present pursuant to the direction given by this Court vide order dated 28.11.2023.

Since the petition stands dismissed as withdrawn, the appearance of the Estate Officer is discharged.
