Mr Amit Gupta, learned counsel, who appears on behalf of the petitioner, says that he has instructions not to press the instant appeal since the skill test is, now, being conducted in line with the amended paragraph 2.3 of „Civil Aviation Requirements‟, Section 7, Series 1, Part V, Issue II dated 20.02.2015 [in short, "Part V Civil Aviation Requirements"]. 1.1 Mr Amit Gupta says that a note to that effect stands incorporated in amended paragraph 2.3 of Part V Civil Aviation Requirements. For convenience, paragraph 2.3 along with the note is extracted hereafter: "2.3 In absence of CFI, a Dy. CFI shall be overall in-charge of the Flying Training Activities. The Flight Instructor (holder of FIR rating) of the FTO, may authorize the flights of the aircraft operated by the FTO.

Note:- Only such FIR holders who have successfully cleared the skill test conducted by DGCA Examiner Assessor or DGCA nominated Designated Examiner can authorize the flights."

Ms Anjana Gosain, learned counsel, who appears on behalf of the respondents, says that she can have no objection to the prayer made by Mr Gupta.
