Present public interest petition has been filed challenging the action of respondent no.1-Directorate of Education (DoE) of shifting of Class Sixth 165 male students from Municipal Corporation Pratibha School, Wazirabad Village, Phase-2, Delhi to the Government Boys Secondary School, Jagatpur Village.

Learned counsel for Directorate of Education, who appears on advance notice, has handed over an order dated 22nd April, 2024 passed by the Regional Director (North & Central), Sarvodaya Vidyalaya Lancer's Road, Timarpur, Delhi, which reads as under:- "No. F.RDE(C)/Misc/2024/89 Date:22.04.2024

ORDER

Whereas, during the annual exercise of admission planning, DDE Zone VII linked the MCD Primary School (Boys), Gali No. 09, Wazirabad (School Id. 1253404) as a Feeder School for admission of its 165 Boys with the Govt. Boys Sec. School, Jagatpur (School Id. 1207255). And Whereas, this linking was done purely in the interest safety and security of the students in order to make sure that these boys do not have to cross the busy stretch of Outer Ring Road (Dr. Hedgewar Marg) and they can study in a school (GBSS, Jagatpur) which is right in their own vicinity. And whereas, quite a number of representations have since been received against this Linkage. In a representation dated 03.04.2024, 52 parents conveyed their unwillingness to send their wards to the nearby GBSS, Jagapur. Representations of Elected Public Representatives where also received in this regard.

And whereas, from the above representations, it can be safely assumed that the local community, especially the parents, have not been convinced about the merits of this Linkage before implementing this. And whereas, this department is fully convinced that, in a democratic system, it is absolutely important to consult and convince all stake holders before taking/effecting any decision.

Now, therefore, keeping in view and respecting the dissatisfaction expressed by the main stake holders (i.e. parents), the aforesaid Linkage of schools between MC Primary School Gali No. 09, Wazirabad (School Id. 1253404) with Govt. Boys Sec. School, Jagatpuri (School Id. 1207255) is amended to the extent that the students of MC Primary School Gali No. 09, Wazirabad (School Id. 1253404) will be free to be enrolled with SBV, Timarpur (School Id. 1207012) as per the earlier practice, in addition to the Govt. Boys Sec. School, Jagatpur.

This issues with the approval of the Competent Authority." 3.

In view of the aforesaid order dated 22nd April, 2024, the grievance raised in the present writ petition stands redressed. Accordingly, the present writ petition is disposed of as satisfied in accordance with the order dated 22nd April, 2024.
