O R D E R

The present petition has been filed by the petitioner seeking directions for the respondent to adjudicate the issue of deficit stamp duty on Share Purchase Agreement dated 01.04.2019.

Arbitration proceedings in respect of the said Share Purchase Agreement are pending. It is noticed that for the want of appropriate stamp duty, the said arbitration proceedings were adjourned sine die with a direction to approach respondent/ collector of stamp for adjudication and payment of stamp duty.

In the aforesaid conspectus, the petitioner filed an application dated 16.10.2024 with the respondent i.e. Sub-Divisional Magistrate / Collector of Stamps, Hauz Khas (South), Saket, New Delhi for adjudication and payment of deficit stamp duty. However, despite months having passed, no effective orders have been passed in the said application. It is submitted that the same is in contravention of the directions given by this Court in 'Uno Minda Ltd. vs. Revenue Department, 2023 SCC Online Del 3598. Learned counsel for the respondent, who appears on advance notice submits that the concerned Sub-Divisional Magistrate / Collector of Stamps, HauzKhas (South), Saket, New Delhi is actively seized of the matter. A hearing has been scheduled tomorrow i.e. on 02.05.2025, for which the petitioner has been directed to appear. He submits that the requisite adjudication shall be done within a period of six weeks from today by way of a speaking order, under intimation to the petitioner. 5.

The above redresses the grievance of the petitioner in the present petition.

The same is accordingly, disposed of.
