The hearing was conducted through video conferencing. 2.

Mr. Vineet Aggarwal, Advocate enters appearance for the respondent. He submits that since the visitation was permitted only for a day on which it was the child's birthday and since the date had already passed, the petition is infructuous.

Learned counsel for the respondent submits that he has filed an application before the Trial Court for interim and final custody of the child and since the matter is pending before the Trial Court, the Trial Court may consider the same in accordance with law. 4.

Learned counsel for the petitioner submits that since the issues of interim and final custody are pending before the concerned Court, she does not press the present petition any further. MAGGU to HMJ Sanjeev Sachdeva.

In view of the above, the petition is dismissed as not pressed. 6.

The Trial Court is at liberty to consider the applications filed by the respondent and the petitioner for interim and final custody of the child in accordance with law.
