By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 730/2017 dated 18.12.2017, registered at Police Station Seelampur, New Delhi, under Sections 420/384/506/34 of the Indian Penal Code, 1860, along with all consequential proceedings arising therefrom.

The said FIR has been registered at the instance of respondent Nos. 2 and 3 and pertains to property bearing Nos. T-208 and T-209, Gautam Puri, Seelampur, Delhi - 110053 ["subject property"]. According to Mr. Shailender Dahiya, learned counsel for the petitioners, the subject property originally belongs to the petitioner's father and paternal uncle. Respondent Nos. 2 and 3, however, claim to have purchased the said property from the petitioner's wife, namely Urmila Devi. Mr. Dahiya further submits that several litigations have already taken place between the petitioner and his wife, in some of which respondent No. 2 was also a party. He contends that the civil proceedings clearly establish the title of the present petitioner, his mother, and his sister in respect of the subject property, and that the present FIR, alleging collusion between the petitioner and his wife, came to be registered only thereafter.

After some arguments, Mr. Dahiya seeks permission to withdraw the present petition. He, however, submits that despite the chargesheet having been filed on 25.04.2023, the proceedings before the learned Trial Court are still pending at the stage of arguments on charge. He accordingly seeks expeditious disposal of the proceedings before the learned Trial Court so as to enable the petitioners to avail appropriate remedies at the stage of framing of charge.

The petition, alongwith pending applications, is accordingly dismissed as withdrawn in terms of the aforesaid submission. 6.
In the event the petitioners move an appropriate application before the learned Trial Court seeking expeditious disposal of the proceedings, the learned Trial Court is requested to consider it sympathetically, having regard to the position of its Board and the age of matters pending before it.

Mr. Dahiya further submits that the petitioner is a senior citizen and is residing outside Delhi. In the event the petitioner moves an application seeking exemption from personal appearance, the learned Trial Court may also consider the same, on its own merits and in accordance with law.

It is clarified that this Court has not expressed any opinion on the merits of the case or on any application that may hereafter be filed by the petitioners, and the same shall be considered by the appropriate Court on their own merits and in accordance with law.
