The instant writ petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been filed by the petitioners seeking quashing of FIR No.490/2022 registered at police Station Mansarovar Park, Delhi under Sections 498A/406/34 of the Indian Penal Code, 1860 ('IPC') on the basis of the Memorandum of Understanding (MoU) dated 23.05.2023 executed between respondent No. 2 and petitioner No. 1 herein. 2.

Learned counsel for the petitioners is present through video conferencing.

The complainant is present in person, who has been identified by the Investigating Officer SI Veena from Police Station Mansarovar Park. are not complying with the orders of this Court. She also states that she is not residing with petitioner No. 1 and a wrong submission has been made by the counsel for the petitioners that the parties are residing together. 4.

Considering the fact that the petition was filed for quashing of the aforementioned FIR on the basis of the settlement and the complainant is not ready for compromise as a fraud has been played upon her, no ground is made out for quashing of the FIR. The complainant is, however, at liberty to take appropriate recourse as available to her in law. 5.

The petition is accordingly dismissed.
