The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the minor son of the petitioner who is alleged to have been taken away by 12 to 15 persons on 12.05.2026.

It is stated that the boy is presently lodged with the respondent no. 2.

Notice is accepted by Mr.Sanjay Lao, the learned Standing Counsel for the State.

The learned Standing Counsel for the State points out that the boy was produced before the Child Welfare Committee-III pursuant to the F.I.R. No.0137 registered at P.S. D.B.G. Road under Sections 3/14 of the Child Labour (Prohibition and Regulation) Act, 1986 read with Sections 75/79 of the Juvenile Justice (Care and Protection of Children) Act, 2015. He, along with 29 other children, was produced before the Child Welfare Committee, which, by an order dated 12.05.2026, has directed them to be kept in the DMRC Home for Boys till 26.05.2026.

In view of the above, the learned counsel for the petitioner prays for leave to withdraw the present petition with liberty to avail of remedies as may be available to the petitioner in accordance with law. 7.
The petition is disposed of as withdrawn, with liberty as prayed for.
