I.A. 7241/2020 This is only an affidavit under Order XI Rule 6 of the Commercial Courts, Commercial Division and Commercial Appellate Division of the High Courts Act, 2018. The same is taken on record. ARB.P 317/2020 1.
The present petition has been filed by the petitioner under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

Mr. Nasir Aziz, learned counsel for the respondent states that the respondent has also filed a petition for appointment of an Arbitrator in the month of June 2020, but the same could not be got listed for hearing in the Court.

I find, both the parties are seeking appointment of an Arbitrator. Even the counsels today have agreed for appointment of an Arbitrator. 4.
Accordingly, this Court appoints Mr.Dinesh Dayal, a retired Additional District Judge, Delhi as the Sole Arbitrator, who shall adjudicate the dispute and differences between the parties. His appointment shall be regulated by the rules of the Delhi High Court International Arbitration Centre.

The petition is disposed of.
