application under Diary No. 270134/2024 supported by an affidavit of its General Manager, in which it is stated that the disputes have been settled and nothing survives to be adjudicated by the Court. Although the application is not on record, a copy has been handed over in Court and is taken on record. The Registry is directed to number the application. 3.

Learned counsel for the respondent is present and states that he has also been instructed that the settlement has been accepted. However, the formal settlement agreement has not been executed. 4.

Having regard to the application filed by NHAI, and in particular the communication dated 08.12.2023 recording the terms of the settlement, both, the petition under Section 34 of the Arbitration and Conciliation Act, 1996, and enforcement proceedings stand disposed of. The parties may apply for revival of these proceedings, if the settlement does not ultimately fructify.
