Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the petition, with the prayer that the Trial Court may be directed to expedite the proceedings. Learned counsel for the petitioner further submitted that it may be clarified that the interim maintenance fixed by the Trial Court shall be subject to the outcome of the final order in the matter and in case the interim maintenance is of a lesser amount, the same shall be adjusted from the final amount. 2.

In view of the submissions of the learned counsel for the petitioner, the petition is dismissed as withdrawn. Pending

application is also dismissed as withdrawn. The Trial Court is directed to expedite the proceedings. It is clarified that in case the respondent No.2 is entitled for a lesser amount than Rs.5,000/-, which was directed to be paid by the Trial Court, the amount already paid would be adjusted from the final maintenance amount.
