BAIL APPL 2303/2020 1.

The present application has been filed on behalf of the petitioner seeking regular bail in FIR No.277/2020, registered under Section 308/34 IPC at Police Station Jaitpur, Delhi.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2020 and the alleged incident arises out of a quarrel which took place on 19.07.2020. He further submits that the petitioner himself suffered injuries and has lodged a complaint in this regard with the concerned Police Station, but no FIR was registered by the police on his complaint. He also submits that the petitioner's complaint filed under

Section 200 Cr.P.C. is pending before the concerned M.M. Learned counsel has placed reliance on the discharge summary of the petitioner wherein it is shown that the petitioner was examined in the AIIMS Trauma Centre on 19.07.2020.

Dr. M.P. Singh, learned APP for the State, on instructions, submits that the injuries suffered by the complainant are simple and blunt in nature and as per the allegations, the injuries suffered are alleged to be caused by bricks, stones and danda.

Looking into the facts and circumstances of the case and the fact that the petitioner is in custody since 20.07.2020 and that the nature of injuries have been opined to be simple, the application is allowed and the petitioner is admitted to bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty M.M. subject to the following further conditions:- (i) The petitioner will not leave NCT of Delhi without prior permission of the concerned Court.

(ii) The petitioner will not directly or indirectly get in touch with the prosecution witnesses and will not try to tamper with the prosecution evidence in any manner.

(iii) The petitioner will remain available on his mobile number:

9811084874, which he undertakes to keep operational at all times during the period of his release on interim bail. In case of change of address of contact details, he shall promptly inform the same to the concerned IO/SHO and the Court.

(iv) The petitioner will remain in touch with IO/SI Shamsher Singh on his

mobile number: 9953024503 or SHO, P.S. Jaitpur on his mobile number: 8750871645 on the first Monday of every month till the filing of the charge sheet.

(v) The petitioner will regularly appear before the Trial Court as and when the charge sheet is filed.
