The present writ petition has been filed seeking action against the unauthorised construction being carried out at the property bearing no. 1896/18, Govindpuri Extension, Kalkaji, New Delhi-110019 (hereinafter 'subject property').

The petitioner resides on the second floor, whereas the respondents no.3 and 4 reside on the upper floor of the subject property. The grievance of the petitioner is that the private respondents have installed a steel gate in the common staircase, which prevents access of the petitioner to the terrace. 3.
Having heard the counsel appearing on behalf of the petitioner, the dispute, which is the subject matter of this petition, is in the nature of a private dispute between the petitioner and the private respondents no.3 and W.P.(C) 6918/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 4. Therefore, the appropriate remedy would be to initiate civil proceedings for the removal of the said gate.

This Court, in exercise of its writ jurisdiction under Article 226 of the Constitution of India, cannot adjudicate issues with regard to the title rights in the subject property.

Accordingly, the petition is dismissed.
