% 08.02.2024 I.A. 3103/2024 (for recording of compromise of suit) in CS(COMM) 420/2022 1.

This is an application filed by the plaintiff under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, seeking to place on record a settlement agreement that has been entered between the parties in the course of mediation.

A copy of the settlement agreement dated 21.12.2023 ["Settlement Agreement"] has been filed with the application. It is signed by the plaintiff, representatives of both the defendants, by their learned counsels, as well as by the learned mediator.

Learned counsels for both parties submit that a decree may be passed in terms of the Settlement Agreement.

Having regard to the aforesaid, I see no impediment to acceding to this request.

The application is allowed and the suit is decreed in terms of the Settlement Agreement dated 21.12.2023.

Decree sheet be prepared accordingly.

As the disputes have been settled in mediation, the Registry is directed to return the Court Fees to the plaintiff in terms of Section 16 of the Court-Fees Act, 1870.

Learned counsel for the defendants states that he is carrying demand drafts for the entire settlement amount. However, learned counsel for the plaintiff is appearing by video conference. Learned counsel for the defendants states that he will coordinate with learned counsel for the plaintiff for handing over the demand drafts. 9.

The next date of hearing 28.02.2024 is cancelled.
