In this call, learned counsel for petitioners has again appeared after taking instructions of his clients with an offer to pay costs of Rs. 1,00,000/- to the respondent/plaintiff for grant of one more opportunity to file Written Statement within one week. if the present petition is allowed and Written Statement is taken on record. It is affirmed by both sides that the subject suit is not a commercial suit. 3.

Accordingly, with consent of both sides, the impugned order is set aside and it is directed that the Written Statement which is stated to have been already filed before the trial court shall be taken on record subject to the petitioners/defendants paying costs of Rs.

1,00,000/- to respondent/plaintiff through counsel within three weeks from today. It is made clear that if the said cost is not paid within the said period, the Written Statement shall not be taken on record.
