% 06.02.2024 [Physical Hearing/Hybrid Hearing (as per request)] RC.REV. 161/2023 & CM APPL. 7088/2024 (for disposal of petition being compromised) This application has been filed by the petitioner under Order XXIII Rule 3 CPC, but in view of submissions made by learned counsel as well as the application being a unilateral one; it is treated as an application under Order XXIII Rule 1 CPC. It is submitted by learned counsel for petitioner and confirmed by respondent no.1(d) that parties have compromised the disputes and the respondents/tenants have handed over the possession of the subject premises to the petitioner/landlord, so nothing is due from either side. Having spoken with both sides, I am satisfied that the disputes stand settled by lawful compromise. The application is allowed. Consequently, the petition is dismissed as withdrawn.
