% 01.09.2017 Learned counsel for the respondent no.2 submits that remedy of appeal is available to the petitioner against the order dated 26th November, 2016 passed by the learned ASJ. However, petitioner has not availed this remedy, therefore, present petition under Section 482 Cr.P.C. is not maintainable.
Petitioner seeks leave to withdraw this petition. However, he submits that he will prefer an appeal along with an application for condonation of delay.
Petition is disposed of as withdrawn. However, if any such application
for condonation of delay is filed along with appeal the same shall be dealt with by the concerned Court on merits.
